Cancellations:
Bina Maya is a small, independently operated accommodation business with only three bookable accommodation options.
Our guests typically book well in advance. When your booking is confirmed, the accommodation is reserved exclusively for you and removed from sale for those dates. Cancellations made close to arrival can be difficult to replace.
For direct bookings, the following cancellation terms apply.
Cancellation 61 days or more before arrival
Cancellations received in writing 61 days or more before the scheduled arrival date will receive a refund of payments made, less an $85 cancellation administration fee.
Cancellation between 60 and 22 days before arrival
For cancellations received between 60 and 22 days before the scheduled arrival date, 50% of the total booking value will be retained as the cancellation charge.
Cancellation 21 days or less before arrival
The full balance of the booking is due 21 days before arrival.
For cancellations received 21 days or less before the scheduled arrival date, 100% of the total booking value will be retained as the cancellation charge.
Resale of Cancelled Dates
Where a booking is cancelled within a non-refundable cancellation period, Bina Maya will make the cancelled dates available for resale but cannot guarantee that a replacement booking will be secured.
If all or part of the cancelled stay is successfully resold, the guest will be refunded the net amount recovered from the replacement booking, up to the amount retained under the cancellation policy, after taking into account:
• the nights successfully resold;
• the amount actually received for the replacement booking;
• any discount required to secure the replacement booking;
• any difference between the original and replacement booking value;
• commissions or booking costs incurred in securing the replacement booking; and
• reasonable direct administration and remarketing costs associated with the cancellation and resale.
Any refund due will be calculated after the original stay dates have passed and the replacement booking has been completed and paid in full.
Illness, Personal Circumstances and Travel Disruption
Our cancellation policy applies regardless of the reason for a guest cancellation, including illness, injury, family circumstances, changes in personal circumstances, flight cancellations or delays, transport disruption, work commitments or other circumstances affecting a guest’s ability to travel.
We understand that unexpected circumstances can arise. However, Bina Maya cannot act as a substitute for travel insurance.
We strongly recommend that guests purchase appropriate domestic or international travel insurance at the time of booking and check that their policy provides suitable cover for cancellation, illness, family emergencies and travel disruption.
Nothing in these Terms and Conditions limits any rights or remedies available under the Australian Consumer Law or other applicable law.
Date Changes
Requests to change booking dates must be made at least 61 days before the scheduled arrival date and are subject to availability.
One date change is permitted per booking.
An administration fee of $85 applies to a date change, together with any increase in the accommodation rate applicable to the new dates.
If the rate for the new dates is lower than the original booking value, the original booking value will be retained and no refund or credit will be provided for the difference.
Once a booking has been transferred to new dates, any further request to change or cancel the booking will be treated as a cancellation and the cancellation policy applicable to the revised stay dates will apply.
Transfer of a Booking
If you are unable to use your booking, you may request to transfer the booking to a friend, family member or colleague.
The replacement guest must accept the booking as confirmed, including the accommodation, dates and these Terms and Conditions.
The replacement guest must provide their full name, address, mobile number and valid payment card details before arrival.
All booking transfers require prior written approval from Bina Maya.
No-Shows, Late Arrivals and Early Departures
Failure to arrive for a confirmed booking will be treated as a cancellation.
No refunds or credits will be provided for no-shows, late arrivals, early departures or unused nights, except where required by law.
Events Beyond Our Reasonable Control
An event beyond our reasonable control may include bushfire, flood, cyclone, severe weather, natural disaster, war, terrorism, civil unrest, public health emergency, epidemic or pandemic, government restriction, widespread loss of essential utilities or another event outside Bina Maya’s reasonable control that prevents or materially affects our ability to provide the booked accommodation.
If such an event prevents Bina Maya from providing the accommodation as booked, we will assess the circumstances and reasonable options available at the time.
Depending on the circumstances and subject to applicable law, options may include:
• transferring the booking to alternative dates;
• providing a credit for future accommodation;
• providing a refund or partial refund; or
• another appropriate remedy.
Alternative dates are subject to availability and the accommodation rates applicable to the new dates. Any increase in price will be payable by the guest.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
Third-Party and Voucher Bookings
The payment and cancellation terms in this document apply to direct bookings made with Bina Maya.
Bookings made through an online travel agency, travel agent, third-party booking platform or voucher provider may be subject to different payment, cancellation and amendment terms.
The payment and cancellation terms provided by the relevant booking provider at the time of booking will apply to those bookings.
